for Markdev Solutions

Who we are

MarkDev Solutions is an IT solutions provider based at A-24, Block 4-A, Gulshan-e-Iqbal, Karachi, Pakistan. Throughout these Terms, “we,” “us,” and “our” refer to MarkDev Solutions, and “you” and “client” refer to the person or organization using the Site or engaging our Services.

Our Services

We provide web development, mobile app development, graphic design, UI/UX, cloud services, IT consulting, cybersecurity, digital marketing, and related IT services. The specific scope, deliverables, timeline, and cost of any project will be set out in a separate proposal, quotation, or service agreement signed by both parties. Where anything in a signed project agreement conflicts with these Terms, the project agreement takes priority.

Use of Our Website

You agree to use the Site only for lawful purposes. You won’t:

  • Attempt to gain unauthorized access to our systems, servers, or any account on the Site
  • Copy, scrape, or reproduce our content, code, or design without written permission
  • Upload or transmit anything that contains viruses, malware, or harmful code
  • Use the Site in any way that could damage, disable, or impair its functioning

We may suspend or restrict access to the Site for anyone who violates these Terms.

Project Engagement & Payment Terms

● Quotations: All quotations are valid for the period stated in the proposal (typically 30 days) unless otherwise agreed.
● Advance payment: Projects generally require an advance payment before work begins, with the remaining balance payable per the milestone or delivery schedule agreed in writing.
● Late payments: We reserve the right to pause work on any project with an overdue balance until payment is received.
● Scope changes: Work outside the agreed scope (additional pages, features, or revisions beyond what’s specified) may be billed separately, and we’ll confirm any extra cost with you before proceeding.
● Currency and method: Payment currency and accepted methods will be confirmed at the time of the agreement.

Intellectual Property

  • Our IP: All content on the Site — including our logo, branding, graphics, and site code — is owned by MarkDev Solutions and may not be used without our written consent.
  • Client deliverables: Ownership of the final deliverables (website, app, design files, etc.) transfers to the client upon full payment, unless otherwise agreed in the project contract. Until full payment is received, all deliverables remain the property of MarkDev Solutions.
  • Third-party tools: Some projects may use third-party platforms, plugins, stock assets, or licensed software. These remain subject to their own licensing terms, and it’s the client’s responsibility to maintain any ongoing subscriptions or licenses after project handover.

Client Responsibilities

  • Our IP: All content on the Site — including our logo, branding, graphics, and site code — is owned by MarkDev Solutions and may not be used without our written consent.

Revisions & Support

Each project agreement will specify the number of revision rounds included. Additional revisions beyond that scope, or post-launch support outside of any maintenance agreement, will be billed at our standard rates unless otherwise agreed.

Warranties & Disclaimers

We provide our Services with reasonable skill and care, in line with standard industry practice. However:

  • We don’t guarantee that any website, app, or software will be completely free of bugs or interruptions
  • We aren’t responsible for third-party service outages (hosting providers, payment gateways, app stores, etc.) that affect a delivered project
  • The Site and its content are provided “as is” without warranties of any kind, express or implied

Limitation of Liability

To the maximum extent permitted by law, MarkDev Solutions will not be liable for any indirect, incidental, or consequential damages — including loss of profits, data, or business opportunity — arising from your use of the Site or our Services. Our total liability for any claim relating to a project will not exceed the total fees paid by the client for that specific project.

Confidentiality

Both parties agree to keep confidential any non-public business, technical, or financial information shared during the course of a project, and not to disclose it to third parties without consent, except where required by law.

Termination

Either party may terminate an ongoing project agreement with written notice, as outlined in the specific project contract. In the event of termination, the client will be billed for work completed up to the termination date, and any advance payments for uncompleted work will be handled per the terms of the signed agreement.

Our Site may contain links to third-party websites. We aren’t responsible for the content, privacy practices, or terms of any external site you access through our links.

Governing Law

These Terms are governed by the laws of Pakistan. Any disputes arising from these Terms or our Services will be subject to the exclusive jurisdiction of the courts of Karachi, Pakistan.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. The “Last updated” date at the top of this page will indicate the most recent revision. Continued use of the Site or our Services after changes are posted means you accept the updated Terms.
